FlotaKM terms of use

These terms are the agreement between Zuhuan Software S.A.S. (tax ID pending), based in Camilo Ponce Enríquez, Azuay province, Ecuador ("Zuhuan Software", "we") and the company or person that uses FlotaKM ("the client", "you"). By creating an account or using the app, you accept them.

1. What FlotaKM is

FlotaKM is an app for iPhone and Android for keeping a fleet of vehicles under control: vehicles and their documents, people and roles, jobs and trips, payments, expenses, each driver's cash, mileage, fuel, handovers with photos and history. It works without signal for up to 7 days and uploads what was recorded when the connection is back.

2. Your account and your people

  • The company account is opened by its owner or administrator with their email. They are responsible for what is done with it.
  • The administrator creates the other people, gives them a role (recorder, driver or observer) and can cut off their access at any time.
  • Each person signs in with their own PIN, which is personal. If you think someone else knows it, change it or ask for a new one.
  • When you enter your people's data, your company is the controller of that data and must have a legal basis to do so (for example, the employment contract) and inform them. We store it on your behalf, as explained in the privacy policy.

3. Subscription and payments

  • FlotaKM is paid for each phone that uses it, monthly or yearly, with package discounts. You see the price for your country in the App Store or Google Play before paying.
  • Apple or Google handle the charge, under their own terms. The subscription renews automatically until you cancel it in your store settings, at least 24 hours before the period ends.
  • The one-phone package includes a 7-day free trial, once per store account. If you don't cancel before, you are charged on day 8.
  • Refunds are decided by Apple or Google, under their rules.
  • If we change prices, we let you know beforehand, and the store asks you to accept them where required.

4. If a payment fails

From that day the company becomes read-only: it can see and download everything, but cannot record anything new. If the store manages to charge, everything works again by itself. After 90 days without payment, we delete the company's data, with email notices at 60, 80 and 89 days.

5. Your data is yours

What you record belongs to your company. You can download all of it, with the photos, in Excel, CSV and PDF at any time, also in read-only mode. We only use your data to provide the service.

6. Proper use

It is not allowed to:

  • use FlotaKM for anything illegal or to store people's data without the right to do so;
  • try to access other companies' data, break the security or overload the service;
  • copy, sell or resell the app, or pretend to be FlotaKM or Zuhuan Software.

If any of this happens, we may suspend the account, letting you know when possible.

7. Availability

We do everything we can to keep FlotaKM always working, with daily backups. Even so, there may be pauses for maintenance or because of internet or provider outages. That's why the app keeps working without signal and uploads everything later. If we plan a long pause, we let you know beforehand.

8. Liability

FlotaKM is a tool: your business numbers and decisions are still yours. Check what gets recorded. To the extent the law allows, Zuhuan Software is not liable for indirect losses, such as lost profits, and its total liability does not exceed what you paid for FlotaKM in the last 12 months. This does not limit any rights the law gives you that cannot be waived.

9. If FlotaKM ever closes

If we decided to close the service, we would do it in an orderly way: we stop selling subscriptions, give at least 30 days' notice, each client keeps everything until the last day they paid for, and then the app stays read-only for 3 months so everyone can download their data. Only then is it deleted.

10. Brand and ownership

The app, its name, its logo and its design belong to Zuhuan Software. We give you permission to use the app while your subscription is active; we don't transfer its ownership to you.

11. Ending

You can stop using FlotaKM whenever you want: cancel the subscription in your store and, if you wish, ask for the account to be deleted (Delete my account).

12. Changes to these terms

If we change them, we publish the new version here with its date and let you know beforehand if the change is significant. If you keep using FlotaKM after the date of the change, you are understood to accept it.

13. Law and language

These terms are governed by the laws of Ecuador. Any disagreement will first be addressed by talking it through; if that isn't possible, the competent courts of Ecuador will decide. If the app was downloaded from the App Store, Apple's standard terms for apps (standard EULA) also apply. If the languages differ, the Spanish version prevails.
